Our Process: What to Expect

Step 1: Free Initial Consultation

Contact us by phone or through our website to discuss your transaction. We will review the details of your deal, explain our services and fees, and answer any questions you have - all at no cost to you.

Step 2: Document Review & Title Search

Once retained, we immediately begin reviewing your Agreement of Purchase and Sale, mortgage instructions, or other relevant documents. We conduct thorough title searches to identify any issues that need to be addressed before closing.

Step 3: Communication & Updates

Throughout your transaction, we keep you informed of progress, upcoming deadlines, and any issues that arise. We communicate with your real estate agent, mortgage broker, and the other party's lawyer on your behalf.

Step 4: Document Preparation

We prepare all closing documents including the deed/transfer, mortgage documents, statement of adjustments, and undertakings. Every document is carefully reviewed to ensure accuracy and protect your interests.

Step 5: Signing Appointment

We schedule a convenient signing appointment - either in person at our Oakville office or remotely via video call at no extra cost. We walk you through every document and explain what you are signing.

Step 6: Closing & Key Exchange

On closing day, we handle the registration of documents, transfer of funds, and coordination with all parties. Once everything is complete, you receive your keys (for purchases) or your sale proceeds.

Understanding Real Estate Closing Costs in Ontario

Beyond legal fees, there are several additional costs involved in an Ontario real estate transaction. Here is a breakdown of common closing costs so you can budget effectively:

  • Land Transfer Tax

    Ontario charges a land transfer tax on all property purchases, calculated on a sliding scale based on the purchase price. Rates range from 0.5% on the first $55,000 up to 7.5% on amounts exceeding $20,000,000. Properties in Toronto are subject to an additional municipal land transfer tax. First-time homebuyers may qualify for a rebate of up to $4,000 on the provincial tax.

  • Title Insurance

    Title insurance is a one-time premium (typically $300-$500) that protects you against title defects, fraud, and other issues. Most mortgage lenders require a lender's title insurance policy, and a separate owner's policy is strongly recommended for your own protection.

  • Disbursements

    These are out-of-pocket expenses your lawyer pays on your behalf, including title search fees, registration fees, courier and delivery charges, software and technology fees, and tax certificates. Disbursements typically range from $500 to $1,000 depending on the complexity of your transaction.

  • Property Tax & Utility Adjustments

    On closing, property taxes and utilities are prorated between the buyer and seller based on the closing date. Your statement of adjustments will itemize these amounts so both parties pay only their fair share.

  • HST on New Construction

    If you are purchasing a newly built home or a substantially renovated property, HST (13%) applies to the purchase price. Some buyers may qualify for the HST New Housing Rebate, which can significantly reduce this cost. Resale homes are generally exempt from HST.
